Interior violating the law and delaying needed mines




It seems that Democrats don’t even like following the laws passed by their own party. The Infrastructure Investment and Jobs Act was passed to look like the party was able to be useful, with one of the provisions for there to be new mines started to make sure the US did not need to rely on nations like China for needed minerals. The Department of Interior has been doing something, but it has already gone past the deadline for the initial report and did not give all the information needed to satisfy the law.

Law Requirements

Here, via a White House press release, is what the relevant section is dealing with.

Working to reform outdated permitting laws and regulations. The Mining Law of 1872 still governs mining of most critical minerals on Federal public lands. The Department of Interior has established an interagency working group (IWG) to advance legislative and regulatory reform of mine permitting and oversight. The IWG released a list of Biden-Harris Administration fundamental principles for mining reform to promote responsible, timely mining under strong community engagement, environmental, and labor standards that avoids the historic injustice that too many mining operations have left behind. Per Section 40206 of the BIL, the working group will deliver recommendations to Congress by November. It will also host public input and comment sessions and work with relevant agencies to initiate updates to mining regulations by the end of the year.

DOI Failures

Here, via the OIG report, is what is happening.

IIJA Section 40206 required submission of a report to Congress by November 15, 2022, that addressed specific requirements. The IWG delivered a final report to Congress on September 12, 2023, with 60 recommendations for reforming mining laws, regulations, and the permitting process. We found that, although the IWG report addressed many of the IIJA Section 40206 requirements, several were not included, and the report did not explain those omissions. Further, we found that it was difficult to assess whether the IWG report met the requirements of Section 40206 because the report was responsive to both Section 40206 and Executive Order No. 14017. Additionally, DOI did not publish a performance metric to evaluate progress expediting permitting activities, which was due on December 11, 2023. We also note that the IWG report was submitted almost 10 months past the IIJA deadline. As a result, Congress and relevant Federal agencies were delayed in their ability to consider the recommendations in the IWG report and may not be able to gauge progress in expediting permitting activities. Because the report did not address all statutory topics, Congress and relevant Federal agencies also may not have all the information needed to determine whether or how to modify mining laws, regulations, and the permitting process.

In addition, we found that the DOI will need to prepare to address the IIJA Section 40206 annual reporting requirement. Attachment 2 outlines the Section 40206 reporting requirements and whether the IWG report met these requirements.

Mining Issues

As reported here, there are several minerals that are needed to be mined in the US to keep the nation running properly. There are rare earths that China controls, which are their own, supplies from Africa, and the refinement process. Russia has major control both over the uranium supply and the refinement process. In other words, the DOI slowing down the process of getting new mines we are having to rely on nations that are not friendly to anyone who doesn’t bow down to them.

Solution Offered

There is a simple solution, any government employee who violates laws needs to go to jail, end of story. If arresting them is so bad for those wanting fewer inmates in a broken prison system, we need to at least fire them. They are putting the nation at risk, as these are needed to make materials for national security. It is time that the Department is cleared out and restocked with people willing to actually work for the American people.

It would seem that the corruption within the DOI is to the point that they are harming industry and national security. They are causing the prices to rise even more. There are so many bad things from these actions that it boggles the mind. It is time to clean house and quit allowing those who wish to harm this nation to have this much power.
