Two members of Congress working to fix one of the many VA issues with a simple solution

 




Veterans in this nation are constantly dealing with issues made worse by the Veterans Administration, but some members of Congress are working to change that. Rep. Derrick Van Orden (WI-3) and Rep. Chris Pappas (NH-1) have introduced the Expedited Equitable Relief Act to make sure veterans and their dependents receive relief within 120 days after administrative errors are corrected. This can mean benefits are awarded, money paid, and other issues solved that were trapped in bureaucratic nightmares.

The Bill

Here, via Van Orden's page, is what the bill says.

(a) AFFIRMATIVE DUTY TO PROVIDE TIMELY EQUITABLE RELIEF.—Section 503 of title 38, United States Code, is amended by striking ‘‘may’’ both places it appears and inserting ‘‘shall, not later than 120 days after such determination,’’.

(b) ELIMINATION OF EXPIRED REPORT.—Such section is further amended by striking subsection (c).

(c) CANCELLATION OF DEBT COLLECTION.—Section 5314 of such title is amended, in subsection (a), by adding at the end the following new paragraph:

‘‘(3) The Secretary shall promptly cancel any agreement, entered into by the Secretary with a debt collector (as defined in section 803 of the Fair Debt Collection Practices Act (15 U.S.C. 1692a)) to collect an amount of indebtedness described in paragraph (1), if the Secretary determines that the determination of such indebtedness was in error.’’.

Statement by Representatives

Here, via a pressrelease, is what Rep. Van Orden and Rep. Pappas had to say.

We have a duty to take care of our veterans,” said Congressman Van Orden. “The last thing they should be worried about is unexpected or incorrect issuances of thousands of dollars of debt. The Expedited Equitable Relief Act will ensure that no one else will be held accountable for VA’s errors besides VA and that they must rectify those mistakes in a timely manner.

Veterans and their families should never face prolonged financial stress from administrative errors at VA,” said Congressman Pappas. “I’m pleased to introduce this bipartisan legislation with Congressman Van Orden to reform VA’s processes for providing quick relief to those wrongly penalized. By ensuring that family members and spouses are made whole in a timely and fair fashion by VA, we continue to honor and pay tribute to those who have sacrificed for our country.”

This makes far more sense than most bills introduced into Congress. Those who have family who are active duty or veterans need to contact their members of Congress to pass this. The VA has too many issues to fix at once, but this would be a very good start.
